Welcome to AgriDrive Limited, a farmer mechanization platform available via mobile application and USSD. These Terms & Conditions ("Terms") govern your use of AgriDrive services, provided by AgriDrive Limited ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.
1.1 Definitions
The following terms have the meanings set forth below:
- "Services" refers to all functionalities provided by AgriDrive, including mechanization services, payment processing, and customer support.
- "Platform" refers to the AgriDrive mobile application and USSD service codes.
- "User" refers to any individual or entity registered to use AgriDrive services.
- "Mechanization Services" refers to the provision of agricultural machinery, equipment, and related services.
- "Mobile Application" refers to the AgriDrive app available on iOS and Android.
- "USSD" refers to Unstructured Supplementary Service Data codes used to access AgriDrive services.
2. Account Registration
To use our services, you must create an account and provide certain information.
2.1 Eligibility
You must be at least 18 years old and a legitimate farmer or agricultural stakeholder to use AgriDrive.
2.2 Registration Information
To create an account, you must provide accurate personal information including:
- Full name
- Phone number
- National ID number
- Location details
- Farm size and type
- Banking/payment information (where applicable)
We may verify your registration information using third-party services or manual checks to confirm your identity and eligibility as a farmer or agricultural stakeholder.
2.2.1 Account Deletion
To delete your account, navigate to the account settings in the mobile application or contact customer support. Account deletion requests will be processed within 7 days, subject to our data retention policy (see Section 8.5).
2.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
3. Services
AgriDrive provides various agricultural mechanization services to its users.
3.1 Mechanization Services
AgriDrive connects farmers with agricultural machinery, equipment, and related services.
Mechanization services include access to tractors, harvesters, and other equipment, subject to availability in your region and equipment specifications listed in the app.
3.2 Platform Access
Services are accessible through:
- Mobile application
- USSD service codes
3.3 Service Availability
Service availability may vary by location and is subject to equipment availability and seasonal demands.
3.3.1 Force Majeure
AgriDrive is not liable for failure to provide services due to force majeure events, including but not limited to natural disasters, government restrictions, or telecommunications failures.
4. Transactions
All transactions on the platform are subject to specific terms and conditions.
4.1 Payment Methods
AgriDrive accepts payments through mobile money, bank transfers, and other specified electronic payment methods.
4.2 Transaction Records
All transactions will be recorded and accessible through your account.
4.3 Charges and Fees
- Service fees will be disclosed before transaction completion
- Additional fees may apply for premium services
- Cancellation fees may apply as specified in the booking terms
Cancellations must be made through the app or USSD at least 24 hours before the scheduled service. A cancellation fee of 10% may apply for late cancellations, as outlined in the booking confirmation.
4.3.1 Payment Disputes
If you believe a transaction was processed incorrectly, contact customer support within 30 days of the transaction. We will investigate and resolve disputes within 14 days, subject to our refund policy.
4.4 Refunds
Refund eligibility is determined by our refund policy, available in the application.
5. User Conduct
All users must adhere to our conduct guidelines when using the platform.
5.1 Acceptable Use
You agree to use AgriDrive services only for legitimate agricultural purposes.
5.2 Prohibited Activities
You may not:
- Provide false information
- Impersonate others
- Use services for illegal activities
- Interfere with platform functionality
- Harass staff or other users
Violation of these conduct rules may result in immediate account suspension or termination, and we reserve the right to pursue legal action for illegal activities.
6. Staff Information
Information regarding our staff and their responsibilities.
6.1 Staff Access
Our staff may access limited user information to provide support and services.
Staff may access your name, contact details, and service requests solely to fulfill bookings, provide support, or ensure service quality.
6.2 Staff Conduct
All AgriDrive staff must adhere to our code of conduct. Report inappropriate staff behavior through our support channels.
6.3 Staff Verification
Equipment operators and service providers are verified before joining our platform.
7. Intellectual Property
All content on AgriDrive, including logos, designs, and software, is our property and protected by intellectual property laws. You may not copy, modify, or distribute platform content without permission.
8. Privacy and Data Protection
We take the protection of your data seriously and comply with applicable regulations.

8.2 Data Usage

- Third-party actions
- Loss or damage to crops or property
- Weather-related service disruptions
AgriDrive and its verified service providers maintain insurance for equipment operations, subject to policy terms. Users are advised to maintain their own insurance for crops or property.
10. Dispute Resolution
How disputes between users and AgriDrive are resolved.
10.1 Governing Law
These Terms are primarily governed by the laws of Kenya where AgriDrive Ltd is headquartered. However, where required by law:
- Users in the European Union may be afforded additional rights under EU consumer protection laws
- Users in the United States may be subject to applicable state and federal laws
- Users in other African nations will be protected by relevant local consumer protection and agricultural regulations
- Where conflicts occur between Kenyan law and mandatory provisions of the law in your jurisdiction, such mandatory provisions may prevail
10.2 Dispute Process
Disputes shall first be attempted to be resolved amicably. If unresolved:
- For users in Kenya and other African nations where no conflicting regulations exist, disputes will be settled through arbitration in Nairobi under the Arbitration Act of Kenya
- For EU users, disputes may be resolved through the EU Online Dispute Resolution platform or competent courts in your country of residence
- For users in the United States, disputes may be resolved through arbitration in accordance with the rules of the American Arbitration Association
- For users in other regions, disputes shall be resolved in accordance with the United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules
Disputes must be reported to AgriDrive within 30 days of the incident or transaction to be eligible for amicable resolution or arbitration.
Notwithstanding the above, users retain the right to bring a claim before their local courts if required by mandatory consumer protection laws in their jurisdiction.
11. Modifications to Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance of revised Terms. Significant changes will be communicated through the app or USSD service.
12. Termination
Details regarding the termination of user accounts.
12.1 Termination by User
You may terminate your account at any time through the app or by contacting customer support.
12.2 Termination by AgriDrive
We reserve the right to terminate or suspend accounts for Terms violations or prolonged inactivity.

- U.S. agricultural regulations and subsidy programs may impact the services available
16.3 African Nations
If you are located in an African nation, the following additional terms apply:
- Local agricultural regulations and subsidy programs may impact the services available
- Where applicable, USSD services will comply with local telecommunications regulations
- Mobile money transactions will adhere to relevant central bank and financial regulations in your country
16.4 Other Regions
For users in regions not specified, these Terms are governed by Kenyan law, subject to mandatory local regulations.
